36C24625AP2319 Contracting Activity: Department of Veterans Affairs Hampton VA Medical Center NCO 6 100 Emancipation Dr Hampton, VA 23667 590-2-25-506-0723 Nature and/or Description of the Action Being Approved: Repair by replacement of two chillers. VAMC Hampton has placed several emergency calls for the Bldg. 116 YCAL Chiller. A thorough evaluation of the chiller has been performed. This chiller is past end of life and uses a refrigerant that has been phased out and will become difficult to procure.

The Chiller at HVAMC Bldg. 146 CH-2-Sy 1 Tandem Comp evaporator barrel is leaking and the parts to repair this are no longer manufactured. The Bldg. 146 chiller is at end of life and must be replaced. Description of Supplies/Services Required to Meet the Agency s Needs:

Building 116: Remove old chiller. Provide crane and rigging to install (1) new (100) ton York YLAA Scroll Chiller M#:

Building 146: Remove old chiller. Provide crane and rigging to install (1) new (100) ton York YLAA Scroll Chiller M#:

YLAA0101HJ46XF S#: TBD (new chiller to sit on existing slab) - new isolators will be provided. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR 819.7009 (DEVIATION) up to $5,000,000. Check the specific VAAR clause used below:

( X ) 819.7008 Sole source awards to a certified service-disabled veteran-owned small business; Demonstration that the Contractor s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): VAAR 819.7008 (DEVIATION) is the authority that allows sole source awards to SDVOSBs based on 38 U.S.C. 8127(c) and that the SDVOSB concern has been determined to be a responsible source with respect to performance.

Additionally, the business meets eligibility requirements in 819.7003(DEVIATION).

Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies: It is the contracting officer s determination that a sole source award is a business decision wholly within the discretion of the contracting officer. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: J&B Hartigan Inc. has successfully provided preventative maintenance and repair since 2022 under contract 36C24622P0066.

There are no past performance issues, and the contract is fair and reasonable. There is noting that indicates the proposal from JBH is anything other than fair and reasonable. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted. It was determined the best course of action is a SDVOSB sole source.
