36C246-24-AP-2099 Contracting Activity: Department of Veterans Affairs, VISN 06, Hampton Medical Center, NCO 6, 100 Emancipation Dr, Hampton VA 23667 2237 590-24-2-985-0078 Nature and/or Description of the Action Being Processed: Hampton VAMC is refreshing their fleet of scopes with newer inventory. Olympus scopes are the only compatible scopes with Hampton VAMC s existing equipment. Olympus is the sole source provider.

Description of Supplies/Services Required to Meet the Agency s Needs: Hampton VAMC is refreshing their fleet of scopes with newer inventory. VAMC Hampton is replacing 28 GI scopes. Statutory Authority Permitting Restricted Competition:Â FAR 13.5 Simplified Procedures for Certain Commercial Items.

The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement.  Competition is restricted on this procurement for the reason below:

       (X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements        Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Olympus is the OEM.

Alliant Enterprises, LLC ( Alliant ) has been selected by Olympus America Inc., Medical Systems Group ( Olympus ) as its exclusive authorized Service Disabled Veteran Owned Small Business reseller for endoscopic and surgical products. Subject to the terms of our distribution agreement, Alliant Healthcare is authorized to purchase products from Olympus and to resell them to the federal government on an Open Market basis or, where applicable, through the Alliant Healthcare FSS, DAPA, or ECAT contracts.

Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: I searched SCMC, FPDS, NAC, SAC and found Olympus is the OEM and has only one Authorized distributor. Olympus scopes are the only scopes that work with VAMC Hampton s equipment. Olympus confirmed they are the sole source that can meet the requirement.

Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The requested scopes are listed on FSS 36F79721D0168 and they are offering a trade in value for existing scopes. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: I searched SCMC, FPDS, NAC, SAC and found Olympus is the OEM and has only one Authorized distributor. Olympus scopes are the only scopes that work with VAMC Hampton s equipment.

Olympus confirmed they are the sole source that can meet the requirement. Any Other Facts Supporting the Use of Other than Full and Open Competition: None Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Olympus and Alliant Health, their exclusive authorized Distributor to the VA, are the only sources.

A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The only thing that could be done is scrap all the scopes and related equipment and compete the requirement. That is not cost effective.
