Intent to Sole Source - Increase Mod - 3C24521P0561 NI GOVERNMENT SERVICES INC

In Accordance with (IAW) the Federal Acquisition Regulation (FAR) Subpart 5.2Â - Synopses of Proposed Contract Actions, the Department of Veterans Affairs, Office of Emergency Management (OEM) has a sole source requirement to modify Contract 36C24521P0561 with NI GOVERNMENT SERVICES INC. IAW FAR Clause 52.212-4 CONTRACT TERMS AND CONDITIONS COMMERCIAL ITEMS (OCT 2018) (c) Changes - Changes in the terms and conditions of this contract may be made only by written agreement of the parties.

OEM will be modifying the existing contract to add 2 additional line items for Option Year 3 and Option Year 4. Each option year shall not exceed 12 months of services. The total contract value shall be increased from $190,686.84, by $132,462.48, for a new contract total of $323,149.32.

The services provided by the vendor are proprietary, and, if not modified, the government would expect substantial duplication in cost and unacceptable delays in fulfilling the agency s requirements that is not anticipated to be recovered through competition. Â Sole Source Justification Network Innovations U.S. Government (NIUSG) is the owner of the services and talk groups that will be used by OEM over the Ligado Networks (formerly LightSquared) MSAT satellite network.

Ligado Networks is the owner and operator of the MSAT satellite network which provides satellite telephony and dispatch radio services throughout North America. Ligado Networks is the only commercial satellite operator in North America offering two-way radio, push-to-talk (PTT) capability integrated with telephony that provides nation-wide interoperability for public safety agencies and will operate with your existing investment in MSAT satellite systems.

On September 14, 2011, Ligado Networks sold its entire direct end user customer base to NI Government Services Inc., a wholly-owned subsidiary of NIUSG. As a result, NIUSG is the only entity that can provide access to all of the services and talk groups that will be used by the OEM organization. NIUSG provides federal, state, local, and tribal entities with national and regional interoperable public safety communications over the Ligado Networks satellite Network.
