Breast Cancer Molecular Testing (BPA) Notice of Intent to Sole Source

The Department of Veterans Affairs Strategic Acquisition Center – Frederick intends to issue a firm-fixed price (FFP) Blanket Purchase Agreement (BPA) on a sole-source basis.

The statutory authority permitting other than full and open competition for this procurement is 41 USC 3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) subpart is FAR 8.405-6(a)(1)(B), which states, “Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.” The requirement is for the procurement of Oncotype Dx Breast Cancer Assay (trademarked by Genomic Health/Exact Sciences) to predict chemotherapy benefit.

The exact test is offered only through Exact Sciences, Corporation, 5505 Endeavor Lane Madison, WI 53719. The applicable North American Industry Classification System (NAICS) code 621511– Medical Laboratories is the most appropriate for this requirement. The size standard is $41.5 million. The Product Service Code (PSC) is Q301 – Medical – Laboratory Testing.
