This is a public notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 – Synopsis of Proposed Contract Actions. The Library of Congress (LoC), Contracts and Grants Directorate (CGD), intends to execute a modification to increase the ceiling of a firm-fixed-price (FFP), indefinite-delivery, indefinite-quantity (IDIQ) contract with Backporch Broadcast Consultants, Inc. (5023 B U Bowman Dr., Buford, GA 30518).
The work to be performed under the contract will be performed at the contractor’s facility. The period of performance (POP) of executed Option Year 2 under the IDIQ contract is 02/01/2024 – 01/31/2025. The base period of performance began 02/01/2022. As a result of this modification, the value of the IDIQ contract will increase from an amount above the simplified acquisition threshold (or SAT, defined as $250,000) to $425,000.00.
The work, which is within the scope of the contract, shall consist of the following,– The contractor shall diagnose, repair (including sourcing and installing replacement parts), replace, and ship video equipment or machines, as well as support equipment, on an as-needed basis. The Library will issue task orders or make purchase-card payments for this work. This announcement constitutes the pre-award notice. Proposals are not being requested from other parties and a written solicitation will not be issued. This public notice accomplishes the following:
1. Notice of the LoC’s intent to execute a sole-source modification for this requirement to modify an IDIQ contract with the business listed herein;
2. Synopsizing the requirements in accordance with the FAR; and 3. Publicly posting the approved Justification and Approval (J&A) to the public in advance of the contract award. As a result of this, a second posting of the J&A is not required after the award has been made. An award notice will be issued following execution of the modification. The following attachments are included in this notice:
Attachment 1: Sole-Source Justification (Redacted for Public Release) Finally, the Library of Congress shall accept capability statements from other prospective businesses and review them for potential changes to its procurement direction. The LoC is not, however, obligated to change directions in this procurement without ample evidence.
