NOTICE OF INTENT TO NEGOTIATE A SOLE-SOURCE CONTRACT

The US Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Office of Marine and Aviation Operations (OMAO), NOAA Ship Rainier requires Engineering Support through AML Oceanographic LTD Field Service Engineering to perform system grooming of the MVP-200 Moving Vessel Profiler onboard the ship. This is a mission critical piece of equipment. This service will be provided by AML Oceanographic Ltd. 800 Windmill Road, Unit 6C Dartmouth, Nova Scotia Canada, B3B1L1.

AML Oceanographic Ltd is the Original Equipment Manufacturer (OEM) for the Moving Vessel Profiler MVP-200. AML Oceanographic has acquired all the proprietary rights to sell service and support the MVP product line from Rolls-Royce. AML does not have any exclusive agreements for sale of the AML equipment in North America for services. Therefore, the government intends to negotiate directly with AML avoiding unnecessary mark ups, delay, warranty, and delivery issues.

The intended procurement is to acquire Support Services to the Moving Vessel Profiler- 200 (MVP) installed on the NOAA ship Rainier. The Government is not aware of any other authorized vendors that can provide this specialized support service and calibration for the system. The Government intends to acquire this part under the guidelines of FAR Part 13, Simplified Acquisitions Procedures and FAR Part 12, Commercial Items.

The Government intends to solicit and negotiate directly with AML Oceanographic Ltd, under the authority of FAR 13.106-1(b)(1)(i). The North American Industry Classification Code (NAICS) for this acquisition is 334513, Instruments and Related Products Manufacturing for Measuring, Displaying, and Controlling Industrial Process Variables with a business size standard of 750 employees. This is not a solicitation for competitive quotes.

However, if any interested party that is an authorized service for the AML MVP grooming and can perform the above requirement, at no additional mark ups, without compromising manufacturing, delivery and warranty may submit a statement of capabilities, which if in timely manner is received, will be considered by NOAA.

A statement of capabilities must be received by 5:00 PM EST on September 3, 2024. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Evidence must be provided of ability to provide the required services.

The capability statement and any other information furnished must be in writing and must contain material in sufficient detail to allow the Government to determine if the party can meet all of the requirements, including an OEM letter to ensure authorization from the OEM for the above services.
