NOTICE OF INTENT TO SOLE SOURCE NOAA's Marine Operations Center, Acquisitions Branch, intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with Silver Ships, Inc of Theodore, Alabama, for the direct replacement purchase of one (1) set of sponson sheaths for NOAA Ship Rainier’s 31’ Silver Ship workboat.
The sole source determination is based on the requirement of Silver Ships 31' work boat sponson, including its specialized sheath configuration, safety features, and installation accessories, is essential to the Government's requirements. Its unique sheath configuration, with 1 each Port and Starboard sheath and 1 Bow flap, featuring a 5" black rubstrake, ensures enhanced durability and protection, crucial for the safe operation of our fleet.
The inclusion of outboard lifelines on the Port and Starboard sheaths further enhances safety for personnel working on the sponson, reducing the risk of accidents and injuries. A "brand name or equal" description cannot be used in this case because the Silver Ships 31' work boat sponson's specialized features are integral to its compatibility and interoperability with our existing Silver Ships boat.
Substituting with an "equal" product may compromise these critical factors, impacting the·sponson's performance and safety. While other companies may offer similar products, they do not meet our agency's needs due to the specific requirements of our Silver Ships work boat. Other products may lack the exact sheath configuration, safety features, or compatibility with our existing fleet, making them unsuitable for seamless integration and operational readiness.
Additionally, modifying other products to meet our needs may not be feasible or cost-effective, as it could compromise their integrity and performance. This notice of intent is not a request for competitive proposals and no solicitation package is available. However, firms that believe they can provide equipment that fully meets the Government's requirements may submit substantiating documentation in writing to the identified point of contact within 15 days after publication of this synopsis.
Such documentation will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to conduct a competitive procurement, based upon responses to this notice, is solely within the discretion of the Government. Oral communications are not acceptable in response to this notice.
