The Government hereby submits a notice of intent to award a sole source Firm-Fixed-Price contract to Agilent Technologies INC. for Maintenance, Service and Replacement Plan on 24 Agilent Equipment for the Navy Environmental and Preventative Medicine Unit No 2 (NEPMU-2), Norfolk, VA. This purchase will be made utilizing Simplified Acquisition Procedures in accordance with Federal Regulation (FAR) Part 13.106-1(b) for purchases not exceeding the simplified acquisition threshold of $250,000.
The contract will consist of a base year and 4 option years; the period of performance for the base year is 01June2024 – 31May2025.
Agilent Technologies INC. is the only source available to provide Maintenance and Service Plan on the Agilent pieces of equipment because Agilent Technologies is the sole source for factory-recommended replacement parts, for proprietary software updates- installed by Agilent licensed service engineers, 3rd party can’t purchase a software upgrade and transfer the ownership to a customer, Agilent trained and certified service engineers that are routinely trained on latest technology and regulatory guidelines, and Agilent is the sole source for proprietary factory-recommended upgrades and service notes, and Agilent Service Guarantee: if they can’t fix an instrument covered by a contract, they will replace it .
The total estimated value is $206,873.40. Responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and would not hinder the mission objective of NEPMU-2. The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will normally be considered for the purposes of determining whether to conduct a competitive procurement.
The Government will not be responsible for any costs incurred by responding to this notice. This is not a request for quote or proposals.
