## Description

The Regional Contracting Office intends to award a sole source purchase order to CyberSecure IPS, LLC. The contemplated contract will acquire proprietary software license renewals, annual maintenance support, off-site technical support, and annual physical calibration services to sustain the existing, government-owned CyberSecure Alarmed Carrier Protective Distribution System (PDS).

This sole-source procurement is conducted under the statutory authority of Title 41 U.S.C. § 1901(e)(2), as implemented in FAR 12.102(a). This regulatory framework mandates that for commercial acquisitions valued at or below the simplified acquisition threshold (SAT), the agency must document the decision that only one source is reasonably available, and this notice serves as the public record of that determination.

The CyberSecure PDS serves as the primary physical cybersecurity line of defense protecting two (2) separate classified fiber-optic network runs within the Joint Interagency Task Force South (JIATFS) compound in Key West, Florida. In accordance with Committee on National Security Systems Instruction (CNSSI) No. 7003, the Government is legally mandated to maintain continuous, automated 24/7/365 tamper and perturbation monitoring of these classified runs. To sustain system operational effectiveness and maintain an active Authority to Operate (ATO), the requirement encompasses:

**Proprietary Software License Renewal & Maintenance:** Annual renewal of the proprietary CyberSecure IMS™ Gold Software License and comprehensive maintenance support across all active monitoring hardware.

**Off-Site Technical Support:** Continuous 24/7/365 telephonic and ticketing technical assistance. Because the physical security system operates on an air-gapped, standalone network, no remote electronic dial-in access is permitted; all technical coordination is handled off-network with on-site Government System Administrators.

**Annual On-Site Preventive Maintenance & Calibration:** One annual physical service visit to the JIATFS compound in Key West, FL, to execute precision hardware calibration of alarmed carrier zones, analyze server resource performance trends, and deliver certified administrator and user training.

Due to the highly proprietary design, firmware, and software source code of the CyberSecure IMS™ infrastructure, only the Original Equipment Manufacturer (OEM), CyberSecure IPS, LLC, possesses the specialized technical data, software updates, and certified calibration capabilities required to service the system. Utilizing an unauthorized third-party vendor would compromise compliance with CNSSI No. 7003, invalidate the system's active network ATO, and void existing hardware warranties.

Consequently, CyberSecure IPS, LLC is the only source capable of satisfying the Government's strict physical and cyber security requirements. This special notice is not a request for competitive quotes. No solicitation documents are available, and telephone requests will not be accepted. However, interested parties may submit a capability statement, proposal, or quotation which shall be considered by the agency.

To be considered, supporting evidence must be furnished in sufficient detail to demonstrate the provider's legal access to the OEM's proprietary source code and software patches, as well as its ability to comply with the technical and physical security requirements stated above. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.
