This will be accomplished on a sole source basis in accordance FAR 13.106-1(b)(1)(i), Purchases not exceeding the simplified acquisition threshold and only one source reasonably available. A determination by the Government not to compete this proposed requirement is based upon the fact that Express Scale Parts, Inc., is the current parts and manufacturer for the Automatic Environmental Sand Bagging System. USACE has invested significant time training personnel from across the enterprise to increase the number of operators available to deploy with the machines. Subsequently, this product continuity is critical to the success of USACE flood response missions; acquiring same type of automated sandbag machine should be procured for the Albuquerque District. Due to the complexity of this machine and operator training, USACE would be unable to commission another company and be consistent and timely in appropriate training for any new machines. These automatic sandbag machines were procured in 2018 and have become a key part of the HQUSACE Emergency Management Program, used to provide flood response at mission critical times. Express Scale Parts, Inc., Automatic Sandbag Machines are desired for purchase, in support of emergency operations and natural disaster relief assistance, in order to maintain a manufacturer, or other supplier available for furnishing supplies or services in case of a national emergency. THIS IS NOT A FORMAL SOLICITATION. This Notice of Intent is not a request for competitive quotations. However, all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. All submissions will be evaluated for the sole purpose of determining whether competitive opportunities exist. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. A determination by the Government not to compete the contract based upon responses to this notice is solely within the discretion of the Government. All responses received within 15 days will be considered. Late submissions will not be considered.
