## Description

The US Army Corps of Engineers, Wilmington District, Wilmington, NC intends to issue a sole source award to Pegasus Professional Services, LLC (UEI GSWCXL8AABJ9) to for install new fiber optic connections between building 17 and building to meet current networking circuit requirements to support USACE Staff. The overarching work is to provide and install fiber optics from Building 17 to Building 3 at the Military Ocean Terminal at Sunny Point (MOTSU), NC.

The contractor shall furnish and install ~1500 ft. of 12 Strand Pre-Terminated (Plenum) PRO-769-S-DP-6fiber optic cable, trench between Building 26 and Building 3 for direct burial fiber, Run inside plant fiber in buildings 26 and 17 to telecom rooms, furnish and install Fiber optic patch panel couplers/connectors and provide OTDR testing report.

Pegasus has an inimitable knowledge of the current wiring configuration of the USACE office spaces/area on MOTSU and has a first-hand knowledge of the physical conditions and environment inherent to working on the MOTSU Facility. As such, Pegasus is reasonably expected to provide the shortest completion date and provide personnel certified to install the affected system components with personnel that already possess the necessary clearances to work on the communication systems as well as work on MOTSU.

**APPLICIABILITY OF AUTHORITY:** The Statutory authority permitting other than full and open competition for this acquisition is the and the Department of the Air Force Federal Acquisition Regulation Supplement (DAFFARS). FAR 13.106-1(b)(1)(i) justifies limiting the source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available.

The purpose of this action is to provide notice of intent for which the Government intends to solicit and negotiate with only one source, Pegasus Professional Services, under the authority of Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the simplified acquisition threshold, the Contracting Officer may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilizations).

This notice of intent is neither a request for competitive quotes nor a solicitation for offers. However, interested persons may identify their interest and capabilities for fulling this requirement. All responsible sources who believe they can meet all of the requirements in the attached Statement of Work may submit a capability statement, or quotation, which shall be considered by the agency. However, determination is solely within the discretion of the Government.

The attached Sole Source Justification outlines the Contracting Officer's justification and reasoning to award a sole source award to Pegasus Professional Services, LLC. This notice meets the requirement set forth by FAR 6.305 Availability of the justification (a) The agency shall make publicly available the justification required by 6.303-1 as required by 10 U.S.C. 3204(f) and 41 U.S.C. 3304(f).
