As provided in FAR 13.106-1(b)(1), for purchases not exceeding the simplified acquisition threshold, (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). The U.S. Army Corps of Engineers, Rock Island District, intends to enter into a firm fixed-price contract with Xylem Dewatering Solutions, Inc. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE QUOTES and no solicitation will be issued. However, any firm that believes it can meet the requirement may give written notification to the Contract Specialist and Contracting Officer in the form of a capability statement. Supporting evidence shall be in sufficient detail that demonstrates the ability to comply with the requirements listed and must be furnished to the point of contact listed below by April 09, 2025 at 10:00 AM Central Time. A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government.
