## Description

This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) subpart 5.2 - Synopses of Proposed Contract Actions. The U.S. Army Corps of Engineers (USACE), Seattle District awards a firm-fixedprice contract to the Montana Department of Environmental Quality (DEQ) for the issuance of Montana Pollutant Discharge Elimination System (MPDES)permits for Libby Dam in Libby, Montana. The statutory authority for this non-competitive acquisition is FAR subpart13.106-1(b)(1)(i).

A MPDES permit is issued by the State Agency in the statewhere the discharge occurs. The Montana DEQ is the only agency able to issuethis permit in the State of Montana. Therefore, the Government awards to the State of Montana to satisfy the agency’s requirement.
