The U.S. Army Corps of Engineers (USACE), Seattle District intends to award a firm-fixed-price contract to the Montana Department of Environmental Quality (DEQ) for the issuance of Montana Pollutant Discharge Elimination System (MPDES) permits for Libby Dam in Libby, Montana. The statutory authority for this non-competitive acquisition is FAR subpart 13.106-1(b)(1)(i). A MPDES permit is issued by the State Agency in the state where the discharge occurs. The Montana DEQ is the only agency able to issue this permit in the State of Montana. Therefore, the Government believes that only one source can satisfy the agency’s requirement. Interested concerns must show authorization to issue MPDES Permits for the State of Montana. If no affirmative written responses are received by 10:00 AM Pacific Standard Time on March 13, 2025, an award will be made without further notice. Electronic responses and questions shall be submitted via email to the contracting points of contact listed below. A determination by the Government not to open the requirement to competition based upon responses to this notice is solely within the discretion of the Government. No solicitation is available at this time.
