## Description

This Notice is being published in accordance with Federal Acquisition Regulation (FAR) requiring dissemination of information on proposed contract actions. This is a notice of intent to sole-source and modify Contract No. W912DS22D0002 with additional contract capacity by $740,000. The statutory authority for this sole-source procurement is FAR 6.301-1, "Only one responsible source and no other supplies or services will satisfy agency requirements."

A separate concurrent effort for a new Biological Testing of Dredged Material contract is currently underway. The new contract is anticipated to be awarded upon depletion of the additional contract capacity. The U.S. Army Corps of Engineers, New York District intends to sole source additional Biology Testing of Dredged Materials services under Contract No. W912DS22D0002 to Aqua Survey, Inc. To date, the U.S. Army Corps of Engineers has awarded $5,298,341.25 in task orders on this contract. The total capacity of the contract is $7,700,000.00. The work being completed under this contract consists of:

sediment and water collection (on contractor supplied vessel); sample handling, processing and shipping; physical and biological analyses (e.g. toxicity and bioaccumulation testing, and physical analyses); QA/QC procedures, and necessary corrective actions. The New York District has identified an increase in the number of projects where sampling and testing will be required during the remaining two years of the current contract. This notice is not a request for competitive proposals.

All responsible sources may submit a capability statement, which shall be considered by the agency. Capability statements must be received by the response date and time of this notice. Submissions will be reviewed to determine if they can meet the requirement. A determination by the Government to compete this proposed modification based upon responses to this notice is solely within the discretion of the Government.

It is anticipated the modification will be made, within approximately fifteen (15) days after the date of this notice unless the Government determines that any other organization has the capacity to meet this requirement. The approved Justification and Approval (J&A), for this modification will be posted following the closure of this notice.
