## Description

This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 - Synopses of Proposed Contract Actions U.S. Army Corps of Engineers - Omaha District, intends to issue a Firm-Fixed Price contract to Crow Creek Sioux Tribe, 100 Drifting Goose Dr, Fort Thompson, South Dakota. This is a service contract to provide labor, service, and equipment for the improvement of wildlife habitat on U.S. Army Corps of Engineers, Big Bend Project lands.

The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 13.106-1(b) Soliciting from a single source (1) for purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action.

The NAICS code is 813312, Environment, Conservation, and Wildlife Organizations. The size standard as defined by the U.S. Small Business Administration is $19.5M. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. If no affirmative written responses are received by 2pm CDT on 25 March 2025, an award will be made without further notice.

Oral communications are not acceptable in response to this notice. A determination by the government not to compete this proposed requirement is solely within the discretion of the government. Responses and question shall be submitted to casey.m.barber@usace.army.mil. The U.S. Army Corps of Engineers is not responsible for any costs incurred by responding to this notice.
