NO SOLICITATION IS AVAILABLE; requests for a solicitation will go unanswered. No award will be made from this Notice. Responses will be used to gain knowledge of potential sources collective bargaining agreements with labor organization(s), whether a PLA has been used in the local area on projects GENERAL SCOPE: This notice is for the evaluation of Project Labor Agreements (PLAs) ONLY. The U.S. Army Corps of Engineers (USACE) Sacramento District (SPK) is conducting market research by soliciting comments from the construction community addressing the potential use of PLAs and to obtain data on the recent history of construction projects in the local labor market of the project under consideration. USACE-SPK anticipates a potential requirement for construction of multiple facilities and utility infrastructure systems to support the planned and future development of the east side of Hill Air Force Base (HAFB), Utah (UT). The work includes the construction of airfield paving (taxiways and tow-ways), associated drainage, and airfield lighting systems. Work will also include construction of a communication information technology node (ITN) building, the relocation of a Tactical Air Navigation (TACAN) facility as well as upgrades and new utility infrastructure to various privately owned (City Light and Power and American Water), public owned, and government owned utility systems including water production (well), storage (water tank), and distribution; sanity sewer, storm sewer, and industrial waste; electrical distribution and communications; natural gas, and compressed air. All facilities and infrastructure systems will be permanent construction in accordance with applicable Department of Defense (DOD) Unified Facilities Criteria (UFC). The potential requirement may result in a solicitation issued approximately 11 March 2024. If solicited, the Government intends to award the contemplated requirement as a firm-fixed-price contract by approximately August 2024. It is estimated that the potential requirement can be completed within 730 calendar days. In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 236.204(iii), the Government currently estimates the magnitude of construction for this project to be between $100,000,000 and $250,000,000. Responses must be limited to four (4) 8.5 x 11-inch pages with a minimum font size of 12-point. PLA Survey. A PLA is a pre-hire collective bargaining agreement with labor organization(s) that establishes the terms and conditions of employment for a specific construction project. Pursuant to Executive Order 14063, Use of Project Labor Agreements for Federal Construction Projects, agencies are mandated to use PLAs for large-scale construction projects (defined as projects where the total cost to the Government of the project is estimated to be at least $35,000,000.00) unless exempted by the agency Senior Procurement Executive. Do you have knowledge that a PLA has been used in the local area on projects of this kind? If so, please provide supporting documentation. Are you aware of skilled labor shortages in the area for those crafts that will be needed to complete the referenced project? If so, please elaborate and provide supporting documentation where possible. Are you aware of time sensitive issues/scheduling requirements that would affect the rate at which the referenced project should be completed? If so, please elaborate and provide supporting documentation where possible. Identify specific reasons why or how you believe a PLA would advance the Federal Government’s interest in achieving economy and efficiency in Federal procurement. Identify specific reasons why you do not believe a PLA would advance the Federal Government’s interest in achieving economy and efficiency in Federal procurement. Identify any additional information you believe should be considered on the use of a PLA on the referenced project. Identify any additional information you believe should be considered on the non-use of a PLA on the referenced project. (Items A-G are the minimum questions that must be included if the requirement is estimated to be >$35M. Items H-R, or any other questions, may be included upon recommendation from the KO, or deleted.) Have PLAs been used on similar projects undertaken by Federal, State, municipal, or private entities in the geographic area where work will be performed? If so, please provide contract number(s) and points of contact. Will multiple construction Contractors and/or Subcontractors employing workers in multiple crafts or trades be required to complete the anticipated work? Is it difficult to recruit or retain a skilled workforce in the anticipated work location? Do you think completion of the project will require an extended period of time? Do you anticipate any unique, compelling, time-sensitive issues, or other schedule requirements to complete the anticipated work (aside from those already noted) or that would affect the rate at which the anticipated project could be completed? If so, please elaborate and provide supporting documentation where possible. Are you aware of any other large-scale projects begin completed in the area during the anticipated period of performance? Do you think requiring a PLA will increase contract costs or contribute to cost savings? Why or why not? How? How do open shop and union wage rates influence prevailing wage rates in the local market area? How does unionization in the local market impact wages? Please provide supporting documentation. Do you think requiring a PLA will increase contract risk? Why or why not? How? If you have previously been party to a PLA, approximately how long did it take to negotiate the terms of the PLA? Did PLA negotiation delay construction start? If so, by how long? Are unionized and non-unionized contractors available to participate on this project? Any other information you think should be considered regarding the use of PLAs for the anticipated project. Please also provide the following information on projects completed in the last 2-5 years: Project Name and Location Detailed Project Description Initial Cost Estimate vs. Actual Final Cost Was the project completed on time? Number of craft trades present on the project Was a PLA used? Were there any challenges experienced during the project? Please submit all responses, statements to the PLA survey as one (1) document, limited to the page maximum above. Responses will not be considered an offer, proposal, or bid for any solicitation that may result from this Notice. Moreover, responses will not restrict the Government to an ultimate acquisition approach. This Notice is for information and planning purposes only. Respondents will not be notified of the results of any PLA Survey conducted or the responses received. NO SOLICITATION IS AVAILABLE; requests for a solicitation will go unanswered. No award will be made from this Notice. Responses will be used to determined potential acquisition strategies, understand current market capabilities, and to gain knowledge of potential sources. GENERAL SCOPE: The U.S. Army Corps of Engineers (USACE), Sacramento District (SPK), anticipates a potential requirement for construction of utility infrastructure systems to support the planned and future development of multiple facilities on the east side of Hill Air Force Base (AFB). The work includes the construction of taxiways, tow-ways, and associated airfield lighting systems; roadways, privately owned vehicle parking, government owned vehicle parking, sidewalks, and emergency vehicle circulation; pump houses, lift stations, and a communication information technology (ITN) node building; and the relocation of a tactical navigation (TACAN) facility, as well as, upgrades to various privately owned and government owned utility systems including water production (well), storage (water tank) and distribution; sanitary sewer, storm sewer, and industrial waste; electrical distribution and communications; natural gas, and compressed air. All facilities and infrastructure systems will be permanent construction in accordance with applicable Department of Defense Unified Facilities Criteria. Special construction and functional requirements: Significant amount of work requires coordination with public, privatized and government installation utilities: Culinary Water (Privatized), Sanitary Sewer (Privatized), Electrical Power (Privatized), Storm Sewer (Government), Natural Gas (Government - connection to public utility, Dominion Energy), Industrial Waste (Government), Fire Water (Government), Communications (Government). SPK is considering the use of a “Price Includes Variation Over Time (PIVOT)” strategy” for this acquisition. The PIVOT approach requires offerors to provide multiple prices that span several periods; empowering contracts to hedge risk over the Government’s predefined periods. Questions and Feedback Regarding PIVOT are in the attachment “Summary of Work with PIVOT.” A virtual Industry Day will be held with potential offerors on Monday, 27 November 2023 at 1:00 PM MST via WebEx. The potential requirement may result in a solicitation issued approximately March 2024. If solicited, the Government intends to award the contemplated requirement as a firm-fixed-price contract by approximately August 2024. It is estimated that the potential requirement can be completed within seven hundred thirty (730) calendar days. In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 236.204(iii), the Government currently estimates the magnitude of construction for this project to be between $100,000,000 and $250,000,000. The North American Industry Classification System (NAICS) code for the potential requirement is anticipated to be 237990, Other Heavy and Civil Engineering Construction. The small business size standard for this NAICS, as established by the U.S. Small Business Administration (SBA) is $45 million annual revenue. The Product Service Code for the potential requirement is anticipated to be Y1NZ, Construction of Other Utilities. If there is a reasonable expectation that at least two (2) responsible small business concerns under this NAICS can provide the anticipated services at fair market prices, the Contracting Officer is required to set the acquisition aide for small business concerns. If competition is set-aside for small businesses, Federal Acquisition Regulation (FAR) 52.219-14, Limitations on Subcontracting, requires that general construction small business Contractors self-perform at least twenty-five percent (25%) of the cost of the contract, not including cost of materials. If no set-aside is made, the requirement is competed full and open competition, and the awarded Contractor is not a small business, the Contractor is required to perform the percent of work identified in the solicitation under FAR 52.236-1, Performance of Work by the Contractor. Contractors with the skill, capabilities, workload capacity, and ability to obtain bonding to complete the project described above (either through self-performance and/or Subcontractor management) are invited to provide capability statements to the point of contact listed below. Other than small businesses are also encouraged to submit Capability Statements. CAPABILITY STATEMENT: Responses must be limited to ten (10) 8.5 x 11 pages with a minimum 10-point font size. Please provide the following information: 1. Company name, Unique Employer ID (UEI; previously DUNS #), address, point of contact, phone number, and email address. 2. Experience and capability to complete contracts of similar magnitude and complexity to the potential requirement, including at least three (3) examples of comparable work performed within the last ten (10) years. Each example should include brief description of the project, description of the work performed (identification of self-performance and/or Subcontractor management), customer name, customer satisfaction, timeliness of performance, dollar value of the project, and whether there were any challenges experienced during the project (delays, investigations, health and safety issues, labor shortages, management/organizational issues, etc.). 3. Business size and socioeconomic type for the applicable NAICS (ex: certified HUBZone, Woman-Owned Small Business, Service-Disabled Veteran-Owned Small Business (SDVOSB), Veteran-Owned Small Business (VOSB), 8(a) Participant, small business, or other than small business (large business)). 4. Bonding capability (in the form of a Surety Letter). Please submit all capabilities, statements, information, brochures, and/or marketing material as one (1) document, limited to the page maximum above. Separately, please submit a second document, limited to three (3) pages with feedback to the following information: 5. PIVOT strategy and Industry Day questions.
