The proposed contractual action will be a Firm-fixed Price (FFP), five-year Indefinite Delivery Indefinite Quantity (IDIQ) overhaul contract, with minimum/maximum quantities listed above. The maximum quantity includes a quantity for Foreign Military Sales. Authority cited is 10 U.S.C. 2304(c)(1) FAR 6.302-1(a)(2)(ii) (B). Only one responsible source and no other supplies or services will satisfy this agency's requirement. The proposed acquisition requires the use of the cited statutory authority because there is no Depot Maintenance Work Requirement (DMWR) available to the Government to overhaul the subject item. The technical data pertinent to this requirement is owned exclusively by the Original Equipment Manufacturer (OEM), Telephonics Corporation and the Prime contractor, Sikorsky Aircraft Corporation. Telephonics and Sikorsky have exclusive rights to the technical data package and are approved sources. Interested parties must have secured the rights to the technical data package to be a potential source for the overhaul of this part. If a new source acquires the proprietary data from the two approved sources during the contract period of performance, the new source can compete in future procurements.
