The rationale for not openly soliciting this requirement is: In accordance with Federal Acquisition Regulation (FAR) 13.106-1 for Brand Name Purchases And In accordance with Federal Acquisition Regulation (FAR) 13.106-3(b)(3)(i) (i) when only one source is solicited and the acquisition does not exceed the simplified acquisition threshold In accordance with FAR 19.502-2(a): each acquisition above the micro- purchase threshold, but not over the simplified acquisition threshold, shall be set aside for small business. In this case; Contracting Officer has determined a formal solicitation for competition is not necessary because the OEM Binder Inc is a small business. The additional administrative cost for solicitation procedures were not deemed warranted and would only cause substantial duplication of cost to the Government that is not expected to be recovered through competition, and unacceptable delays in fulfilling the agency’s requirements. The main characteristic for which USDA-APHIS-PPQ-CPHST Miami Lab selected Binder is its ability to maintain both temperature and humidity stable for long periods of time. The lab has other incubators such as Percival and Panasonic.
