\n\nThe Environmental Protection Agency hereby gives notice of its intent to award a sole-source, firm-fixed-price commercial contract to Apex Instruments, Inc. (204 Technology Ln, Fuquay-Varina, NC 27526) under the authority of RFO Part 13.
\n\nThe objective of this procurement is to acquire starter package renewal accounts, administrator renewal account and proprietary, factory-calibrated replacement Smart Gas Cartridges.
\n\nMarket research has determined that Apex Instruments, Inc. is the North American distribution rights holder, and certified warranty service provider for this specific hardware and software line. No other standard commercial distributors or authorized third-party resellers exist in the U.S. domestic open market.
\n\nThe Apex AIR Pro platform is uniquely required to meet agency mission parameters due to its:
\n\nThis is not a request for competitive proposals, and a written solicitation will not be issued.
\n\nHowever, in accordance with federal acquisition guidelines, all responsible sources may submit a capability statement, proposal, or quotation. Any response received within 10 days of publication of this notice will be thoroughly evaluated by the government solely for the purpose of determining whether to conduct competitive procurement. A determination by the Government not to compete this proposed action based upon responses to this notice is solely within the discretion of the Government.
