KG Manufacturing successfully passed validation/verification testing by the P-8 Test and Evaluation team and this P/N has been documented via the Automated SERD system as the Navy approved aircraft stairs for the P-8 and C-40 programs. As Original Equipment Manufacturer (OEM), KG Manufacturing has the proprietary rights to the technical data and drawings and is the only known source with the requisite knowledge of the design, fabrication, performance, and operational characteristics of the stairs. The Government intends to procure the above services under the statutory authority of Title 10 U.S.C. Section 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) Section 6.302-1, only one responsible source. FAR 6.302-1(a)(2)(iii)(A) states services may be deemed to be available only from one responsible source when it is likely that award to any other source would result in a substantial duplication of cost to the Government that is not expected to be recovered through competition.
