## Description

The Naval Air Warfare Center Aircraft Division Lakehurst, NJ (NAWCAD LKE) intends to solicit, negotiate, and award a firm-fixed price contract on a sole source basis with Eclypse International (CAGE: 0JJ26) for the procurement of the EA-18G Airborne Electronic Attack (AEA) Automatic Wire Test Set (AWTS) Test Program Set (TPS) in support of the EA-18G aircraft. Eclypse International is the original designer, developer, manufacturer of the AWTS, and owns the technical drawings for this part.

In addition, Eclypse International is the creator of the programming language used for AWTS TPSs. Since the AWTS and the programming language used for the AWTS TPSs are proprietary to Eclypse International, they are the only company with the knowledge, tools, and software data rights to design, develop, produce, and test EA-18G AEA AWTS TPS. The Government does not have the technical drawings for this part to allow for a competitive procurement.

The Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1, 10 U.S.C. 3204(a)(1) “Only one responsible source and no other supplies or services will satisfy agency requirements” for this action. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, the Government will consider all responses received within fifteen days after the date of publication of this synopsis.

Registration in the System for Award Management (SAM) (https://www.sam.gov) is mandatory for consideration. A determination by the Government not to open the requirement to competition based on the responses to this notice will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
