Testek LLC is the OEM of the AGTS. They own the technical data and is the sole designer, developer and manufacturer. Testek LLC is the only company that has the corporate knowledge and expertise required to train and provide technical assist for the AGTS. The government does not possess the required technical data to effectively solicit this requirement by full and open competition. No other manufacturer would have this data and are capable of successfully meeting the Government’s requirement. NAWCADLKE intends to award this modification under the authority of 10 U.S.C. 3204(a)(1) (formerly known as 10 U.S.C. 2304(c)(1)), as implemented in FAR 6.302-1. Interested firms may identify their interest and capability to respond to the requirement. This notice of intent is not a request for competitive proposals; however, the Government will consider all responses received to this notice. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government. Information received as a result of the notice of intent will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. No solicitation will be available for this
