IS A NOTICE OF INTENT This Notice is issued in accordance with Federal Acquisition Regulation (FAR) subpart 5.201 to notify the public of a proposed contract action. The proposed contract action is for the acquisition of engineering, installation, operation, and maintenance of the Armed Forces Network (AFN) Naples Frequency modulation (FM) Radio broadcast systems, permitting US Military and Government personnel and their families to receive important command information, news, sports, and AFN entertainment Radio Programming in the Naples military community and surrounding civilian communities. The NAVSUP FLC Sigonella intends to solicit and negotiate with only one source under the authority of FAR 6.302-1 by entering into a sole source contract with RAY WAY SPA. RAI WAY SPA is the only known source able to provide the required services. See the Sole Source Justification and Draft Performance Work Statement for additional information. The statutory authority permitting other than full and open competition is 41 U.S.C.253(c)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled “3304(a)(1) sole source specifications, which reads in part, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” This notice of intent in not a request for capability statements or competitive proposals; however any firm who believes it can perform the required services may give written notice to the Contracting Officer within 10 days of publication of this Special Notice. Supporting evidence must be in sufficient detail to demonstrate the ability to comply with the requirement. Responses received will be evaluated; however a determination by the Government to compete the requirement based on the responses to this Special Notice is solely the discretion of the Government.
