## Description

The Portsmouth Naval Shipyard requires Excel Scaffolding required for a repair and maintenance of a Virginia Class Submarine. The Navy has confirmed that Excel Modular Scaffold and Leasing Corporation is the original equipment manufacturer and has exclusive ownership rights in the relevant technical data, proprietary information and equipment for the required scaffolding equipment needed. The statutory authority permitting other than full and open competition is 41 U.S.C. § 1901(e)(2), as implemented by Federal Acquisition Regulation FAR 12.102(b) (Only one responsible source and no other supplies or services will satisfy agency requirements).
