This action will be conducted under Federal Acquisition Regulation (FAR) Part 12 and Part 13. The Government intends to purchase on a firm fixed-price basis and to solicit the proposed purchase order as a Sole Source to Keysight Technologies. Keysight Technologies is the original equipment manufacturer (OEM) of the equipment and is the only OEM authorized to repair and/or calibrate these units. Repair and/or calibration is required because we lack the ability to repair and/or calibrate these units in-house. These units need repair and calibration due to damaged parts. Offerors must be registered in the System for Award Management (SAM) database prior to submission of an offer to be considered for award of any DoD contract. This may be accomplished electronically at https://www.sam.gov/portal/public/SAM. Solicitation Award all or none See Attached RFQ. No terms will be incorporated into any price quote and/or order accepted by the Government unless otherwise agreed to by all parties in writing. Any and all terms and conditions contained in any price quote and/or order that violate any Federal laws, statutes, and regulations, including but not limited to, the Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulation Supplement (DFARS) are void and will have no effect. The applicable Federal laws, statutes, and regulations, including, but not limited to, the FAR and DFARS will govern instead. The Government intends to award this on a sole source basis. This notice of intent is not a request for competitive quotes. A determination by the Government not to compete this proposed contract based upon the responses to this notice is solely within the discretion of the government.
