This BOA will be utilized by the United States Navy/United States Marine Corps (USN/USMC), the Unites States Army (USA), the United States Air Force (USAF), other United States Government Departments or Agencies, and Foreign Military Sales (FMS) cases. These requirements will be procured in accordance with the statutory authority permitting other than full and open competition under Title 10 U.S.C 3204(a)(1), as implemented by FAR 6.103-1, \"Only one responsible source and no other supplies or services will satisfy agency requirements.\" As the sole designer, developer and manufacturer of the APKWS II weapon system, BAE Systems Electronic Solutions (BAE) is the only source that currently possesses sufficient requisite knowledge, engineering expertise, aircraft integration information, and technical data required to perform these efforts. No other source has the technical qualification and necessary resources to perform the work described herein, nor will any other supplies or services satisfy the Government's requirements.
