Reg. 61185 (October 3, 2013), and the Patent and Trademark Office Efficiency Act (PTOEA) 35 U.S.C. § 2(b)(4)(A). As a result of its exemptions, the USPTO is not required to meet the test of “full and open competition” as defined in FAR Part 6 and may use agency-specific acquisition procedures as described below when the circumstances warrant it and it is in the best interest of the agency to do so. Consequently, USPTO intends to make a sole source BPA Award to support its portfolio-wide real property planning as well as specific GSA consultation support for pending GSA space assignment actions across the USPTO portfolio. After previously posting an RFI (ACQ-27-0182) to sam.gov which closed on 9/24/26, USPTO received 2 legitimate small business responses and have identified FD Stonewater, LLC (FDS); 1001 N. 19th Street, Suite 1401, Arlington, VA 22209; UEI:L26UHZU1XC37 as the contractor able to most likely meet the agency’s needs for this requirement. As a result, per (PTOEA) 35 U.S.C. 2(b)(4)(A as further defined in PTAG 6.1.1 (d) USPTO intends to negotiate and award a firm fixed BPA with FDS to meet this requirement.
