## Description

This is a notice of intent to award a sole source task order in accordance with FAR 16.505(b)(2)(G) and FAR 6.302-1(a)(2)(iii). This is not a request for competitive quotes/proposals. The United States Army Corps of Engineers- Louisville District (USACE-LRL), intends to award a sole source Firm-Fixed Price task order to Pond and Company- FSB Joint Venture to design a new tank level monitoring system for the fuel hydrant system at Niagara Falls Air Reserve Station.

Pond and Company- FSB JV was awarded Task Order W912QR21F0109 to design repairs to the existing fuel hydrant system at Niagara Falls Air Reserve Station, NY in the fiscal year 2021. Now, as a requirement of DLA providing fuel for the system, a new tank level monitoring system needs to be installed. Pond and Company- FSB JV has been selected for the new requirement based upon their familiarity with the project and ability to complete the design without a substantial duplication of costs or substantial delay.

Therefore, the Government intends to award the task order to Pond and Company-FSB JV without positing a solicitation for competition. However, all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Responses to this notice must provide clear and convincing evidence that competition would benefit the government, would not be prohibitively expensive or time-consuming, and that interested parties would be likely to participate. The Government will not be responsible for any costs incurred. Responses must be received via email at Charity.A.Mansfield@usace.army.mil by 31 August 2024.
