For this procurement, the USPTO is exempt from the Competition in Contracting Act (CICA) as the subject requirement is being procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG) and the Patent and Trademark Office Efficiency Act 35 U.S.C. 2(b)(4)(A). The full text is located here: https://federalregister.gov/a/2013-24316 The USPTO seeks to increase its efforts to reach out to military veterans, to include transitioning or soon to be separated military veterans and their families when pursuing opportunities to fill current USPTO Agency employment requirements. The USPTO will require a partner who has access to potential employees at their current military service locations, or within the immediate vicinity of Department of Defense (DoD) installations. A private sector solution is needed to accomplish these recruitment goals. We have identified RVET OPERATING LLC DBA RecruitMilitary. RecruitMilitary offers events on military installations, city-based, virtual, and private in-person as part of its service which are unavailable from any other source. RecruitMilitary is the only company contracted by the U.S. Army’s Human Resources Command and the Department of Labor for veteran hiring. RecruitMilitary conducts over 100 hiring events each year. RecruitMilitary also offers targeted events which incorporates pre-event recruitment marketing to specific candidate profiles as well as resume portal access combined with its unique job posting portal prior to scheduled events. To make this sole source determination and in accordance with PTAG 6.1.1 (b), the USPTO conducted market research which included an extensive review of SAM.gov, GSA Advantage, FPDS, SBA DSBS as well as targeted web-searches, reaching out to vendors, and other federal agencies. This resulted in identifying only one firm that provides the specific services required by the USPTO. As a result, per PTAG 6.1.1 (d) the USPTO intends to negotiate and award a firm fixed price contract or BPA with RVET OPERATING LLC DBA RecruitMilitary to provide access to its military recruitment fairs. This requirement utilizes NAICS code 561311 and has a period of performance that includes a one-year base period with four option years from date of award. This notice of intent is not a request for competitive proposals nor will a solicitation be issued to the public.
