## Description

This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopses of Proposed Contract Actions" US Army Corps of Engineers; Portland District intends to award a sole-source, Firm-Fixed Price contract with Siemens Product Lifecycle Management (PLM) Software, Inc., 5800 Granite Parkway, Suite 600, Plano, TX 75024-6612.

The purpose of this acquisition is to furnish software license agreement renewal of the STAR-HPC (#1401.2) and STAR-CCM+ Add 1 (#1106.2) for the duration of a one (1) year period. The software is proprietary to Siemens PLM. The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 13.106-1(b) for purchases not exceeding the simplified acquisition threshold. A SOLICITATION WILL NOT BE POSTED The Government intends to proceed with this sole source action.

The NAICS code is 511210 Software Publishers. The size standard as defined by the U.S. Small Business Administration is $38.5 mil. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. All responsible sources may submit a quote to the contracting officer before the notice end date.

If no affirmative written responses are received by 1:00 PM Pacific Time on March 08, 2024 an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government. The U.S. Army Corps of Engineers is not responsible for any costs incurred by responding to this notice.
