## Description

Under the authority of Title 41 United States Code (U.S.C.) §1901(a)(1) as implemented in the Revolutionary FAR Overhaul (RFO) Federal Acquisition Regulation (FAR) 12.102(a), the U.S. Army intends to award a sole source, firm-fixed-price purchase order to 3dB Labs, Inc., 9050 Centre Pointe Dr., STE. 340, West Chester, OH 45069. Their CAGE Code is 34XG3. This requirement is for user training on the 3dB Labs, Inc. software.

The requirement is for two training events on the signal processing proprietary software owned by 3dB Labs, Inc. The estimated value is not-to-exceed the simplified acquisition threshold. 3dB Labs, Inc. is the Original Equipment Manufacturer (OEM) of the specialized hardware and the developer of the proprietary software used by this hardware. The company maintains full proprietary rights to the software's source code, system architecture, and all related materials.

3dB Labs, Inc. has not authorized or certified any third-party vendors to provide the required training. As such, 3dB Labs, Inc. is the only source capable of providing the services that will satisfy the agency's requirements. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. There is no solicitation document available for this requirement.

However, all responsible sources that believe they can meet the requirements may submit a capability statement, proposal, or quotation, which shall be considered by the agency, if received by the response date. A decision by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.
