## Description

THIS NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. Department of Transportation, Federal Highway Administration, Central Federal Lands Highway Division (CFLHD) hereby provides notice of its intent to award a sole-source firm fixed contract to the California Coastal Comission for habitat mitigation credits as a result of disturbed habitat from the construction of the CA FLAP SCR T5(1) Monterey Bay Sanctuary Scenic Trail project.

A Justification and Approval for Other Than Full and Open Competition has been prepared per RFO 6.103-1. Habitat mitigation is required for the CFLHD project; CA FLAP SCR T5(1) Monterey Bay Sanctuary Scenic Trail. This is a requirement under the United States Army Corps of Engineers (USACE) Nationwide Permit 14 under Section 404 of the Clean Water Act and the California Regional Water Resources Control Board under Section 401 of the Clean Water Act.

Further, mitigation is also required by the U.S. Fish and Wildlife Service (USFWS), California Coastal Commission (CCC), and the California Department of Fish and Wildlife (CDFW). There are six different sensitive habitat types to mitigate for: Palustrine Emergent Wetland (.27 acres) Arroyo Willow Riparian Forest (2.51 acres) Arroyo Willow Scrub (3.60 acres) Coastal Shrub/Scrub (5.98 acres) Sand Dune (.27 acres) Coast Live Oak Forest (.41 acres) The above acreage are the impacted areas.

Mitigation Credit purchases are typically obtained through mitigation banks. However, there are no known mitigation banks servicing the project area that fulfill the mitigation requirements. A determination to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. CFLHD will NOT be responsible for any costs incurred by interested parties in responding to this notice of intent. Only written responses will be considered.

Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Any response to this notice must show clear, compelling, and convincing evidence that competition will be advantageous to the Government.
