IS A PRESOLICIATION NOTICE A REQUEST FOR PROPOSAL WILL BE POSTED ON OR ABOUT MARCH 31, 2025 (i.e., estimated) Oklahoma City Veterans Affairs Health Care System (OKC VA HCS) Statement of Work (SOW) ASBESTOS ABATEMENT AND REMEDIATION Project Number: 635-22-127 Project Title: Asbestos Abatement and Remediation INTRODUCTION/BACKGROUND Currently, there are numerous areas throughout the Oklahoma City Veterans Affairs Medical Center (OKC VAMC) that have materials that contain asbestos referred to hereafter as Asbestos Containing Materials (ACM). These areas pose a health and safety threat for all occupants within the facility and is justification for abatement and remediation. The Contractor will provide abatement and remediation of ACM following all applicable regulations and procedures. Contractor will replace finishes in affected areas as required while following hospital safety and Infection Control standards. OBJECTIVE The Contractor shall provide: all necessary testing and survey work by Contractor s certified industrial hygienist (CIH) all necessary pre-abatement work including the creation of asbestos abatement drawings provided by designer certified within the state of Oklahoma and approvals; for constructing and maintaining work area isolation; abatement work, removal, and disposal of ACM; for a third party independent certified industrial hygienist to represent the VA hereafter referred to as the VPIH and all necessary testing by VPIH specific Transmission Electron Microscopy (TEM) testing must be performed to certify decontamination of work area; as needed for replacing/refinishing affected/impacted area finishes; for removal of isolation work area throughout the hospital as indicated by this and supporting documentation. SCOPE OF WORK Contractor will isolate work areas, conduct any necessary demolition of finishes, abate and remediate ACM, remove and dispose of ACM, replace/restore/refinish impacted work area finishes, and remove work area isolation. Safety specifications and approved infection control risk assessment (ICRA). Infection Control is critical in all medical center facilities. Interior construction activities causing disturbance of existing dust, or creating new dust, must be conducted within ventilation-controlled areas that minimize the flow of airborne particles into patient areas. An infection control risk assessment (ICRA) must be performed by VA personnel in accordance with Facility Guidelines Institute (FGI) Guidelines. Contractor shall reference Appendix I as the VHA ICRA form and understand that different work areas within the hospital will require different levels of prevention related to Infection Control. Contractor is to coordinate and comply with Infection Control requirements for isolation of work areas. The scope of work also includes containment, storage, transportation and disposal of the generated ACM wastes. The abatement work will be conducted by a state-certified asbestos abatement contractor licensed in the State of Oklahoma and managed by the Contractor. The Contractor is responsible for understanding, disseminating, implementing and adhering to this project specification document. The Contractor will be responsible for coordinating site work efforts with the VAMC Representative and VPIH. The Awarded Contractor shall assume full responsibility and liability for compliance with all applicable Federal, State and Local regulations related to any and all aspects of the abatement project. The Contractor is also responsible for retaining the services of a Certified Industrial Hygienist (CIH) to generate an \"Asbestos Hazard Abatement Work Plan\", that is due on or before the pre-construction meeting as a part of the required pre-job submittals. The Contractor is responsible for providing for the services of a third party independent certified industrial hygienist to perform as the VPIH throughout the project. VPIH must be approved by the Contracting Officer. The Contractor will be responsible for all costs incurred by the VPIH. The Asbestos Hazard Abatement Work Plan submittals must be approved by the Contracting Officer and the VPIH before beginning work. The following procedures and required information must be detailed within the Asbestos Hazard Abatement Work Plan: Regulated area preparation procedures. Decontamination area set-up/layout and decontamination procedures for employees. Abatement methods/procedures and equipment to be used. Personal protective equipment to be used. Procedures for handling, packaging and disposal of asbestos waste. Emergency Action Plan and Contingency Plan Procedures. Proof of Contractor licensing. Proof the Competent Person(s) is trained and accredited and approved for working in this State. Verification of the experience of the Competent Person(s) shall also be presented. A list of all workers who will participate in the project, including experience and verification of training and accreditation. A list of and verification of training for all personnel who have current first-aid/CPR training. A minimum of one person per shift must have adequate training. Current medical written opinions for all personnel working on-site meeting the requirements of 29 CFR 1926.1101 (m). Current fit-tests for all personnel wearing respirators on-site meeting the requirements of 29 CFR 1926.1101 (h) and Appendix C. Notification requirements procedure of Contractor as required in 29 CFR 1926.1101 (d) for Multi-Employer Worksites. As a part of the Asbestos Hazard Abatement Work Plan the Contractor is also responsible for producing \"Asbestos Abatement Drawings\" that include the following information: Integrated Phasing on execution of abatement with a summary of square footage of floor space for abatement, total linear and square footage of asbestos to be abated. Major Decontamination Areas (when applicable) showing limits of sealing off the location, quantities of ACM, arrangements of auxiliary rooms, engineering of negative air systems, path of asbestos to loading platform & locations, and connections to required utilities. Minor Decontamination Areas (when applicable) showing location, type and length of pipe element to be abated by \"Glove Bag\" approach and any other abatement features. Locations of restoration of impacted building sub-systems. The Contractor is also responsible for providing and maintaining training, accreditations, medical exams, medical records, personal protective equipment as required by applicable Federal, State and Local regulations. The Contractor shall hold the VA and VPIH/CIH consultants harmless for any failure to comply with any applicable work, packaging, transporting, disposal, safety, health, or environmental requirement on the part of himself, his employees, or his subcontractors. The Contractor will incur all costs of the VPIH, including all sampling/analytical costs to assure compliance with VA/OSHA/EPA/State requirements. Contractor will provide for VPIH to conduct Transmission Electron Microscopy (TEM) testing as required to certify decontamination of work area for VA compliance per VA specifications. Please note that the Contractor is responsible for ensuring all required paperwork is submitted to the Oklahoma Department of Environmental Quality (ODEQ) and EPA for form Notification of Demolition and Renovation. ODEQ requires notification to the start of asbestos abatement activities. All forms are referenced in Appendix E. The work specified herein shall be the abatement of asbestos-containing materials by certified and registered persons who are knowledgeable, qualified and trained in the abatement, handling, and disposal of asbestos-containing material, and subsequent cleaning of the affected environment. The contractor shall supply all labor, materials, equipment, testing, services, permits, notifications, insurance, and incidentals which are necessary or required to perform the work in accordance with applicable local, state, and federal regulations as may be necessary for the abatement of asbestos-containing materials and for other work as specified in this section or as indicated in associated drawings, sketches, or details of the work. Any actions taken by the Contractor without obtaining guidance from the Contracting Officer shall become the sole risk and responsibility of the Contractor. All costs incurred due to such action are also the responsibility of the Contractor. The work tasks are summarized as follows: Pre-abatement activities including pre-abatement meeting(s), inspection(s), notifications, permits, submittal approvals, work-site preparations, emergency procedures arrangements, and standard operating procedures for Class I and II asbestos abatement work. Receiving approval for phasing plan of project from VA representative and VPIH. Receiving approval for pre-abatement work plan for each work area by VPIH before work shall begin. Following the approved ICRA and Asbestos Hazard Abatement Work Plan in constructing required spaces for abatement to be used for isolation of work area, decontamination. Conduct any demolition if required to access ACM. Abatement activities including removal, clean-up and disposal of ACM waste, recordkeeping, security, monitoring, and inspections. Cleaning and decontamination activities including final visual inspection, air monitoring and certification of decontamination. Replacing or refinishing the work area with new finishes as required. Following approved ICRA to remove temporary partitions or barriers. The Contractor shall designate an Abatement Superintendent, subject to the approval of the CIH and review of the VPIH. The Superintendent shall meet the requirements of all applicable regulations and perform the following minimum requirements: The Abatement Superintendent must be certified and licensed as an Asbestos Abatement Supervisor and must have two (2) years full time experience in asbestos abatement work. Shall be on site whenever work is in progress. Maintain a daily log on the project, documenting events, visitations, problems, equipment failures, accidents and inspections. Ensure that all workers are wearing appropriate personal protection equipment. Implement first aid, safety training, respiratory protection, and ensuring all workers are trained in emergency procedures. Conduct visual inspection of the work area prior to the visual inspection done by the owner's representative. This inspection shall be documented on the form \"Contractor's Superintendent Visual Inspection Report\", located in Appendix D of this specification. Supervise activities of any subcontractors of the Contractor to ensure compliance with contract documents. Duties shall include those for the \"Competent Person\" as defined in Appendix H the Construction Specifications. The Contractor and Contractor's personnel shall cooperate fully with the VAMC representative/consultant to facilitate efficient use of buildings and areas within buildings. The Contractor shall perform the work in accordance with VA specifications, approved asbestos abatement drawings, approved phasing plan and in compliance with any/all applicable Federal, State and Local regulations and requirements. The Contractor shall coordinate and schedule all phases of the work of the contract documents under his control with the VAMC Representative, any subcontractors, materials suppliers, and other parties involved as necessary to ensure the smooth and orderly transition of separate phases, timely placement of items and materials, cooperation between parties, and proper execution of the work. The Contractor shall use the existing facilities in the building strictly within the limits indicated in contract documents as well as the approved pre-abatement work plan. The approved pre-abatement work plan shall show the limits of regulated areas; the placement of decontamination facilities; the temporary location of bagged waste ACM; the path of transport to outside the building; and the temporary waste storage area for each building/regulated area. Any variation from the arrangements approved shall be secured in writing from Contracting Officer and VPIH through the pre-abatement work plan. Asbestos-Containing Material Identification The Asbestos-Containing Materials Inspection Report and associated drawings will be attached to the solicitation. It is the Contractor's responsibility to verify all quantities prior to bid preparation and demolition/renovation activities. The tables will outline the quantity of ACM to be abated in the OKC VAMC by tier and area/floor/level. NORMAL OPERATING HOURS Normal work hours are 7:00 AM to 4:30 PM Central Time (CT), Monday through Friday excluding Federal Holidays. Contractor must obtain written permission from the Contracting Officer at least 4 working days prior to work on Saturdays, Sundays, or Federal holidays. Any change in the work schedule must be approved in writing by the Contracting Officer, Contracting Officer Representative (COR) and VPIH. The following Federal legal holidays are observed by this facility: New Year s Day January 1 Martin Luther King s Birthday Third Monday in January President s Day Third Monday in February Memorial Day Last Monday in May Juneteenth June 19 Independence Day July 4 Labor Day First Monday in September Columbus Day Second Monday in November Veteran s Day November 11 Thanksgiving Day Fourth Thursday in November Christmas Day December 25 CONTRACTOR STAFF AND EMPLOYEES Prior to commencing work, the contractor shall provide the Contracting Officer with the telephone number at which the contractor or his/her designated representative may be contacted at any time during regular working hours and an emergency number which the contractor may be contacted in situations requiring immediate attention. The above-mentioned representative, if provided, must be delegated in writing to act on the behalf of the principle/President/CEO of the company. Site Superintendent The Government shall not exercise any supervision or control over the contractor s employees performing services under this contract. Such employees shall be accountable not to the Government, but solely to the contractor, who, in turn, is responsible to the Government. At all times during the performance of the contract, and until the work under this contract is completed and accepted, the contractor shall directly oversee the work, or assign a competent representative who is satisfactory to the Contracting Officer and has authority to act for the contractor. This may include a working supervisor. Contractor s Employees. All work under this contract shall be performed in a skillful and workmanlike manner. The Contracting Officer may require, in writing, the contractor to remove from the job site any employee the Contracting Officer deems incompetent, careless, or otherwise objectionable. PROGRESS MEETINGS Progress meetings shall be held (frequency determined by the C.O.), between the contractor and the Government to discuss work progress, problems and potential modifications. PERIOD OF PERFORMANCE A specific period of performance shall be of 240 days under this contract commencing upon notice to proceed from the C.O. SPECIFICATIONS Construction specifications can be found in Appendix H. Work is to be accomplished in accordance with VA MASTER CONSTRUCTION SPECIFICATIONS SECTION VA 02 82.11,13.13,13.19,13.21,13.31,13.41, and VA 02 83.33.13 . This regulation is available for review at the VA Office of Construction & Facilities Management Technical Information Library (TIL) at https://www.cfm.va.gov/til/spec.asp#02. A copy of each section is available for review by the contractor for work required. All work performed should comply with EPA s 40 CFR 7763 Subpart E, 40 CFR part 61, subpart M, OSHA 1910.1001, 1926.1101, 1910.134. Related requirements and conditions for this project include applicable codes and regulations, notices and permits, existing site conditions and restrictions on use of the site, requirements for partial owner occupancy during the work, coordination with other work and the phasing of the work. In the event the contractor discovers a conflict in the contract documents and/or requirements or codes, the conflict must be brought to the immediate attention of the Contracting Officer for resolution. Whenever there is a conflict or overlap in the requirements, the most stringent shall apply. SCHEDULING OF WORK Before commencement of work, the contractor shall confer with the COR, as well as the building occupant, and agree on a sequence of procedures; means of access to premises and building; space for storage of materials and equipment; delivery of materials and use of approaches; use of corridors, stairways, elevators, and similar means of communications; location of partitions, eating spaces, and restrooms for contractor employees; and the like. Delivery of materials and equipment shall be made with a minimum of interference to Government operations and personnel. The work shall, so far as practicable, be done in definite sections or divisions, and confined to limited areas which shall be completed before work in other sections or divisions is begun. Most work will be performed in occupied areas. The contractor shall take all precautions to ensure that no damage will result from his operations to private or public property. All damages shall be repaired or replaced by the contractor at no cost to the Government. The contractor shall be responsible for providing all work site protective barriers and site control devices. This includes but is not limited to protective fences; protective tapes; and protective signage. During our site walk, we were informed that a portion of the 7th Floor has already been abated under a prior project. Please confirm whether any ACM on the 7th Floor has been previously removed. If so, identify which rooms/areas are excluded from this scope. Answer No. 4: It has been confirmed; 635-16-101 Renovate 7 East project was concluded in early 2021 with as-built documentation as the design for this project was initiated in late 2021. The project documentation and quantities are believed to be current. Question No. 5: The solicitation (Part I/Section F Specifications and Drawings ) states no elevators shall be used for materials handling. However, onsite COR guidance suggested the freight elevator may be available for ACM waste removal. Please clarify whether the Contractor may utilize the freight elevator for transporting equipment, personnel, or waste. If permitted, advise any size or scheduling restrictions. Answer No. 5: It is not guaranteed or reserve the right to use an elevator for this contract. The contractor may be permitted to use the freight elevator at the discretion of the facility. There is only one freight elevator available for use and it has a posted weight limit of 5000 lbs and is approximately 84 inches deep, 74 inches wide, 88 inches tall, and with a doorway of 54 inches wide and 84 inches tall. Question No. 6: The bid documents do not designate specific locations for contractor parking, equipment staging, or waste container placement. Please provide the approved parking/staging areas for personnel vehicles, equipment trailers, and ACM waste containers, including any site-specific restrictions. Answer No. 6: Due to the number of construction projects currently in and planned for, construction impacting the availability of parking to our veteran patients and their families, the OKC VA Medical Center (VAMC) will not guarantee or provide on premise parking within this contract. The OKC VAMC can coordinate with the contractor for location of a dumpster and, any approved location will prioritize the VAMC. The contractor may request but is not guaranteed anything additional. It is the responsibility of contractor personnel to park only in designated parking areas. Parking information is available from the VA Police. The VA shall not validate or make reimbursement for parking violations of the Contractor s personnel under this contract under any circumstance. If so, please specify whether this work is to be performed by skin ning the building exterior or by interior demo methods, and whether it must be complete under occupied conditions. Question No. 14: Many of the area s removals will be done in electrical/mechanical/occupied areas, will someone from facilities be able to assist with any shutdown of electric and HVAC if necessary to complete the abatement work? Answer No. 14: Any Shutdowns must be coordinated with the COR and CO in advance; any major shutdowns will need to be requested at least 2 weeks in advance to proposed date for work to be completed. The contractor must provide adequate detailed information of the proposed shutdown and impact for the COR to submit any and all requests for review and approval of executive leadership team and stakeholders impacted. Question No. 15: During the walk-through it was obvious that the identified items for removal listed on the sheets provided do not match up with what exists in the areas. Will the government provide someone to go ahead of the abatement contractor and clearly identify items? Answer No. 15: No, Please review SOW III.E&F&Q as Asbestos Hazard Abatement Work Plan is to be generated by Certified Industrial Hygienist (CIH) and should be responsible for identification. Contractor is also responsible for providing for a Certified Industrial Hygienist to be third party to represent the VA as VPIH. Q. Asbestos-Containing Material Identification It is the Contractor s responsibility to verify all quantities prior to bid preparation and demolition/renovation activities Question No. 16: The black spray on mastic is applied to CMU block that is porous, the only way to completely remove this material would be some type of blasting operation, this will be difficult to do in the areas where the material is located. The other option would be to use a chemical mastic remover that would not get the material out of the pores in the CMU block. Is the goal to completely remove this material or will the best effort be acceptable? Answer No. 16: Mastic removal directly from brick or block surfaces is not part of this project s scope. Should any of the quantities for black mastic be identified as applied directly to brick, or block surfaces then the contractor must inform the COR and CO immediately and credit back the quantity of ACM s associated abatement/remediation costs. Question No. 17: Any pipe/duct insulation that is removed will most likely leave the pipes/ducts sweating and obviously reduce efficiency of the system, will the abatement contractor be responsible for re-insulation or temp covering of these areas? Answer No. 17: The Contractor that is awarded this contract will be responsible for re-insulation of these areas. Coordination of replacement insulation in a timely manner to best maintain the efficiency of the system is expected. Any section of piping should not be uninsulated for duration greater than 24 hours. Question No. 18: What area(s) will be provided for the abatement contractor to stage materials, equipment, decontamination unit, breakroom trailer, and disposal dumpster? Answer No. 18: Due to the number of construction projects currently in and planned for, construction impacting on the availability of parking to our veteran patients and their families, the OKC VA Medical Center (VAMC) will not provide any staging areas or trailers. The OKC VAMC can coordinate with the contractor for the location of a dumpster and any approved location will prioritize the VAMC. Question No. 19: Will the abatement contractor being utilized for this work be required to hold a current Oklahoma Asbestos Abatement Contractors License per ODOL regulations?
