This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The Government reserves the right to make no award from this solicitation. * The deadline for all questions is 4:00pm MT, March 15, 2024 All questions must be submitted in writing no later than the question cut-off date marked above. Wheeling Street Aurora, CO 80045 52.212-1, Instructions to Offerors--Commercial Items applies to this acquisition ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS COMMERCIAL Gray market items are Original Equipment Manufacturer s (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers.Â No remanufactures or gray market items will be acceptable. Offeror shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM.Â All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions. The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract.Â Accordingly, the VA reserves the right enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items. Offerors providing an or equal product(s) must adhere to the terms in FAR 52.211-6. If an item in this solicitation is identified as brand name or equal, the purchase description reflects the characteristics and level of quality that will satisfy the Government s needs. The salient physical, functional, or performance characteristics that equal products must meet or exceed are specified in the solicitation. To be considered for award, offers of equal products, including equal products of the brand name manufacturer, must Meet the salient physical, functional, or performance characteristic specified in this solicitation; Clearly identify the item by- Brand name, if any and Make or model number, Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and Clearly describe any modification the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modification. The contracting officer will evaluate equal products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the contracting officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer. Unless the offeror clearly indicates in its offer that the product being offered is an equal product, the offeror shall provide the brand name product referenced in the solicitation. Any award made as a result of this solicitation will be made on an All or Nothing Basis. No, the government will not provide a NAICS change at this time. The items are not being sold but rather leased. The chosen NAICS code best fits this requirement. Q2. Is there a site visit scheduled for this requirement? if a site visit/survey is a possibility. A site survey would be beneficial when determining factors such as space constraints, power outlet availability, and storage availability. Â A2. There is not a site visit scheduled. The large machine is in a space that measures 14 . The smaller machine in in a space that measure 10 10 . Â There is space that can accommodate larger machines but would require a little reorganization. See attached pictures for more information. Q3. Is a brand-new contract OR if there is (was) an incumbent performing these services. If not brand new, could you please provide the current / previous contract number? A3. This is a new contract for a color production copier. A previous contract was only for a black and white production copier. Therefore, there was not a prior contract to perform these exact services. Q4. The RFP notes the VA is looking for two 125PPM units with various specified capabilities. Vendor recommends that the VA consider a solution for three 90 PPM machines with even more capabilities. A4. The VA is unable to change their salient characteristics due to the waiver provided by Government Printing Office. Q5. Will the VA allow for a second NAICS code to be added to the solicitation. A5. No, the VA will allow NAICS provided in the solicitation Q6. Could you clarify the need for the Secure Print feature on the device? A6. Secure print is Network printing from virtual Server that allows for PIV/CAC access. Q7:Â Would either (or both) devices require any color embellishment capabilities? A7. Unknown. Possible 1 machine, but value of having feature for future projects not known. Q8: Are the dimensions of the space available to the bidders to confirm the service and operation envelope, on-site storage, along with power requirements? A8. Current machines reside in 2 spaces. The first space is 10 10 in length and the second space is 14 in length. Power appears to be conventional 220v with converter for current machine plug configuration. Q9. The RFQ states The Contractor shall also track how the copy, print, scan and fax capabilities of the devices are being utilized; track device usage, service issues and service resolution metrics; and maintain user satisfaction. As the requested devices are Production Copiers and not general use MFD s, they report output as Color & Black usage and not Copy, Scan, or Fax usage. As this RFQ specifies 2 Production Copiers machines, not fleet MFD devices, the Industry Standard Print Controllers do not integrate with CAC/PIV as the Print Controller are a computer system with the Unique Print Processing solution connected to the Copier/Printer. Please refer to the statement of work concerning the required salient characteristics. Q24. Is the VA requiring the functionality of FAX on these 2 Production Copier machines? A24. Yes. Q25. Please note that our MFPs run an embedded, hardened proprietary OS, which is not Windows based. We don't allow any executable software to run on any of our devices, and don't require anti-virus software, as no trojan can run inside the device. The system is impervious to viruses and worms. We have never had a single instance of malware ever infecting any of our MFDs or printers. This eliminates the need for a whitelist. Please amend this requirement to state equivalency, as while we do not require anti-virus software for security as tested for HCD PP v1.0 certification. If the anti-virus requirement cannot be removed, please confirm that alternate AV options are acceptable. A25. This is normal for MFDs they are devices and as such cannot run software AV, it has to be built into the Firmware. Q26. We fully support Cisco ISE 802.1x as a device native feature without embedding Cisco middleware. Please amend this requirement to state equivalency. A26. As long as the VA can put the equal option on the network, the VA will accept an equivalent. Q27. Please also note that our devices do not have Hard Disk Drives. Solid State Drives do not require multiple pass overwrite. This function is no longer necessary for SSDs because of their different technology than Hard Disk Drives (HDD). Similar options that HDD devices may include for security functionality are inherent to SSDs to maintain performance (e.g. garbage collection and wear leveling). Please amend this requirement to allow for Solid State Drive wear leveling technology, as data cannot be retrieved from an SSD when overwritten in a single pass. A27. VA requires all hard drives be destroyed through a shredding contract, so the devices would be returned without the hard drive or SSD drive. Q28. Web-based fleet management tool exceeds the configuration and management functions of Fleet Orchestrator, which is specific to one OEM only. Please remove the Fleet Orchestrator brand requirement (or state equivalent) or advise that this is a sole source acquisition. A28. The VA will accept an equal. Q29. In the interest of fair and open competition, will VAECHS review and revise this requirement to Up to 120PPM laser color production copier . A29. Our SOW says up to 125 PPM Q30. For essentially all vendors, capacity requirements of 10,000 sheets will increase the overall footprint of the proposed equipment by 3 feet or more. Does VAECHS require inline trimming of the top, bottom, and face of the booklet?
