## Description

Under Statutory Authority 41 U.S.C. 1901 the VA Great Lakes Acquisition Center (GLAC) intends to negotiate a sole source contract with GE Healthcare for full-service maintenance of Datex-Ohmeda Aestiva, Avance, and Respiratory Module anesthesia equipment located at the William S. Middleton Memorial Veterans Hospital in Madison, WI. Service will consist of preventive (scheduled) maintenance and corrective (unscheduled) repairs, including all necessary replacement parts.

GE is the OEM and maintains certain proprietary service technologies relating to these products. This acquisition is conducted under the authority of 41 U.S.C. 1901 Simplified acquisition procedures as implemented in FAR 13.501, only one responsible source and no other supplies or services will satisfy agency requirements. This will be a firm fixed price contract for a base year plus four (4) one-year options. The NAICS Code is 811210. This Notice of Intent is not a request for competitive quotes.

No solicitation documents are available and telephone requests will not be honored. However, if a firm believes it can meet the requirements it must furnish information about its products and services, as well as references from other customers who are using these products and service to the Contracting Officer by 10:00AM (CST) 4/24/2024. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the above requirements. This evidence shall include the following:

1. A letter from the Original Equipment Manufacturer (OEM) stating vendor is an authorized distributor per clause 852.212-71(c).

2. Proof vendor can purchase OEM parts.

3. Proof all technical personnel are OEM certified.

4. Proof vendor is authorized for any necessary software access.

5. Proof vendor can utilize OEM s billable service, if using.

6. Proof vendor can can commence emergency on-site repairs within 8 operating hours. Responses received will be evaluated however; a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no responses are received, the Contracting Officer will proceed with the sole source negotiation with GE Healthcare.

VAAR 852.212-71 GRAY MARKET AND COUNTERFEIT ITEMS (FEB 2023) (a) No used, refurbished, or remanufactured supplies or equipment/parts shall be provided. This procurement is for new Original Equipment Manufacturer (OEM) items only. No gray market items shall be provided.

Gray market items are OEM goods intentionally or unintentionally sold outside an authorized sales territory or sold by non-authorized dealers in an authorized sales territory. (b) No counterfeit supplies or equipment/parts shall be provided.

Counterfeit items include unlawful or unauthorized reproductions, substitutions, or alterations that have been mismarked, misidentified, or otherwise misrepresented to be an authentic, unmodified item from the original manufacturer, or a source with the express written authority of the original manufacturer or current design activity, including an authorized aftermarket manufacturer.

Unlawful or unauthorized substitutions include used items represented as new, or the false identification of grade, serial number, lot number, date code, or performance characteristics. (c) Vendor shall be an OEM, authorized dealer, authorized distributor, or authorized reseller for the proposed equipment/system, verified by an authorization letter or other documents from the OEM.
