## Description

Description The Veterans Health Administration (VHA), Office of Research and Development (R&D), Regional Procurement Office (RPO) East in Pittsburgh, PA intends to negotiate on a sole source basis with ElectroCore. The requirement is for the procurement of Vagal Nerve Stimulation Devices. The requirement is for the contractor to provide and ship these items (all components that make up this system) to the VA Atlanta Health Care System.

This procurement shall be inclusive of shipping and handling charges (FBO Destination). This procurement is being conducted IAW FAR 6.302-1, Only one responsible source and no other supplies will satisfy agency requirements. This is because the Government asserts that ElectroCore, is the only contractor that can provide this specific equipment needed by the R&D Laboratory at the VA Atlanta Health Care System. Specifically, the characteristics of the Vagal Nerve Stimulation Devices that are unique are as follows:

This procurement project is for Vagal nerve stimulation is felt to have positive effects on the brain and body by fighting the effects of stress, reducing pain (including headaches), and helping memory. A surgically implantable Vagal Nerve Stimulation (VNS) device has been approved by the Food and Drug Administration (FDA) for the treatment of both epilepsy and severe depression. Studies have shown that VNS stimulation is helpful for both conditions. This notice of intent is not a request for competitive proposals.

This requirement is brand name/equal to procurement. Price reasonableness will be a factor of selection. However, any responsible source who believes it is capable of meeting the requirement may submit a capability statement/quote and supporting documentation to the Contracting Officer no later than Friday, 5/17/2024, (12pm, CST). A determination not to compete the proposed requirement based upon the responses to this notice is solely within the discretion of the Government.
