## Description

QUESTIONS & ANSWERS Could you confirm if an SBA Non-Manufacturer Rule (NMR) waiver (under 13 CFR 121.406) has been, or will be, granted for this specific procurement? The performance requirements (limitations on subcontracting) and the non-manufacturer rule do not apply to small business set-aside acquisitions with an estimated value between the micro-purchase threshold and the simplified acquisition threshold.

To provide a kit under FSS schedule which would result in TAA compliance but the additional cartridges that are needed would not be covered but the additional parts are covered under FAR Overhaul 25.104(a)(30) spare and replacement parts for equipment of foreign manufacture, and for which domestic parts are not available.
