## Description

NOTICE OF INTENT TO AWARD SOLE-SOURCE The Department of Veteran Affairs, Veterans Health Administration, Network Contracting Office 6, Hampton VA 23667, intends to negotiate a sole-source Firm-Fixed Price contract for the procurement of the Varian Aria/Eclipse Service Full-Scale Maintenance (Emergency Requirement) for the Durham VA Medical Center with Varian Medical Systems, Inc. in accordance with 41 U.S.C. §3304(a)(1) as implemented by FAR 6.302-1 Only One Responsible Source.

This purchase will be made under Simplified Acquisition Procedures and Other than Full and Open Competition as authorized by FAR 13.106-1(b). This is not a request for competitive offers, and no solicitation is available. Market research has determined that these items are highly specialized and are only available from a single source without an unacceptable delay or duplication of cost. No other type of items will satisfy agency requirements.

The Government intends to award the contract with an effective date of March 05, 2024, to Varian Medical Systems, Inc.; 3100 Hansen Way, Palo Alto, CA 94304-1030, SAM UEI: PHMMJPNSNZV5. Radiation Oncology Services currently utilizes the Varian Aria/Eclipse software solution for its oncology patients. The Radiation Oncology software manages departmental, administrative, and clinical activities. It also provides for scheduling clinical activities and activities for billing purposes.

The Eclipse Treatment Planning System plans radiotherapy treatments for patients with malignant or benign diseases. The Eclipse TPS is highly specialized software used by medical professionals trained in radiation dosimetry for patients considered suitable for radiotherapy by an oncologist. Eclipse is used to plan external beam irradiation with photon electron and proton beams and for internal irradiation treatments.

Software support for Varian Software is already in use at the Durham VAM, proprietary to Varian Medical Systems, Inc. NCO 6 requires service for continuous preventative maintenance on Varian departmental, administrative, and clinical activities. It also provides for scheduling clinical activities and activities for billing purposes.

The software being covered by this contract is ARIA Radiation Oncology and TPS Eclipse Essentials Services, which will include software updates, help desk support, maintenance, and training. As the OEM of the equipment, Varian Medical Systems, Inc. provides the unique capability to service its equipment and provide proprietary updates and support. No other vendor can provide maintenance and support for this equipment.
