**July 5, 2024 Brief Description of Services:** The Department of Veterans Affairs (VA) office of Construction & Facilities Management requires contractor support to achieve the aggressive undertaking of executing its backlog of developed construction projects. VA faces funding challenges for its extensive portfolio of over 50 fully designed projects due to current market conditions, leading to chronic project underfunding.

Viewing this as an opportunity, VA plans to reassess each project to maximize value delivery within budgetary constraints. To achieve this, they will develop a prioritization strategy considering project risks, market demand, and other pertinent factors.

The contractor shall provide support in the development of a project prioritization strategy and provide facilitation between project stakeholders, including Veterans Health Administration (VHA), CFM, and industry partners to determine project requirements, budget constraints, and innovative solutions to meet the requirements of the Agency.

The contractor shall have extensive experience in federal procurement, design, and construction in order to provide Owner Advisor support to VA, providing guidance and expertise throughout the delivery process to include assistance in implementing collaborative delivery methods new to VA. This will consist of providing input on project strategy, risk management, and performance monitoring.

The support provided will enable VA to more effectively take on their initiatives to streamline their processes and clear their growing backlog to better serve our Nation s veterans.

**Reason for Sole Source:** This activity proposes to make a non-competitive award (sole source) to ELK Consortium, LLC, a SBA certified verified Service-Disabled Veteran Owned Small Business (SDVOSB), under the statutory Authority of Public Law (PL) 109-461, Veterans First Contracting Program, as codified at 38 U.S.C. 8127 and 8128 and implemented at Veterans Affairs Acquisition Regulation (VAAR) Subsection 819.7007(c). 38 U.S.C. 8127(c) permits a contracting officer to award a contract to a verified SDVOSB using procedures other than competition if:

1) such concern is determined to be a responsible source with respect to performance of such contract opportunity;

(2) the anticipated award price of the contract (including options) will exceed the simplified acquisition threshold (as defined in section 134 of title 41) but will not exceed $5,000,000; and (3) in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price that offers best value to the United States. This proposed action meets all three of the requirements of 38 U.S.C. 8127(c). In accordance with FAR 6.305(a) the justification supporting this action will be made publicly available within 14 days after contract award.
