## Description

Sole source acquisition of:

Kin-Tek FlexMixer dilution system with optional MFC and fittings, Plus FlexStream permeation oven.

**Proposed Vendor:** Kin-Tek Analytical, Inc. 504 Laurel St. La Marque, TX 77568 USA. This Kin-Tek instrumentation is a direct replacement for existing Kin-Tek equipment that is currently in use in the lab. The existing equipment is worn out and has reached the end of its useful lifespan. Repairs are not economical and/or not possible. This new equipment is a direct replacement with the same shape, design, accuracy, and operation as the older equipment that are currently in use in the lab.

The Kin-Tek instruments can be easily swapped with the existing instruments that the lab needs to replace. NIOSH procedures, test systems, and trainings are all set up specifically for this equipment. A web search was performed to find any similar instruments, and none were found with the required accuracy, usability, and design. No other device will be able to seamlessly integrate with the existing test systems and procedures. The statutory authority permitting other than full and open competition is 41 U.S.C.

3304(a)(1) as cited in FAR 6.302-1, " Only one responsible source and no other supplies or services will satisfy agency requirements." Responsible sources that believe they possess the expertise and capabilities identified above are encouraged to submit to the Contracting Officer within 7 days from the posting date of this notice, their written capabilities statement which shall be considered by the agency.

Information received in response to this announcement will be used solely for the purpose of determining whether to conduct a competitive procurement. If no affirmative responses are received within 7 days, negotiations will be conducted with Kin-Tec as the only source and a contract will be issued without any additional notices being posted.
