## Description

This notice is being published in accordance with the Federal Acquisition Regulation (FAR) Subpart 5.101 requiring dissemination of information for proposed contract actions. This is a notice of intent to award a sole source Purchase Order and is not a request for competitive quotes/proposals. The statutory authority for this sole source procurement is prescribed by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.

**Background:** The U.S. Embassy Kyiv requires the procurement of original spare parts for its existing Multistack chillers. These chillers are currently installed at the Embassy and are essential for maintaining the cooling systems that support mission-critical operations. To ensure operational compatibility and reliable performance, only original equipment manufacturer (OEM) spare parts from Multistack can be used for repairs and maintenance.

The specific components required are proprietary to Multistack and are not available through other manufacturers or authorized distributors. Equivalent parts from other brands are not compatible with the Embassy’s chiller systems and may compromise the performance, safety, and integrity of the equipment. The use of non-OEM parts could result in system malfunction, costly damage, or extended downtime, directly impacting Embassy operations.

The U.S. Embassy Kyiv intends to issue a firm-fixed price purchase order to Multistack, LLC, on or about September 10, 2025. The estimated total award amount is $16,000.00. The North American Industry Classification System (NAICS) code for this requirement is:

333415 – Air-Conditioning and Warm Air Heating Equipment and Commercial and Industrial Refrigeration Equipment Manufacturing. This notice is not a request for proposals or quote. However, all responsible sources may submit a capability statement demonstrating the ability to provide the services requested, which shall be considered by the agency before the intended award date. Interested sources who submit data are responsible for appropriately marking information if it is proprietary in nature.

The Government shall not reimburse interested sources for any information provided. No requests for capability briefings will be honored. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.
