## Description

The U.S. Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Eastern Region Acquisitions Division, intends to award, on a sole source basis, under the authority of FAR 13.106-1(b)(1), with SevenCs GMPH, Zirkusweg 1, Hamberg, Germany, for 35 concurrent licenses of SevenCs Analyzer and 35 licenses of Analyzer Chart Display Module, S-58 validation software that will validate NOAA’s Electronic Navigational Charts to the International Hydrographic Organization’s S-58 and S-57 standard for the Marine Chart Division (MCD) and Office of Coast Survey, in Silver Spring, MD.

Sole Source Justification This software package has been updated to the latest version of the IHO S-58 validation checks which has introduced a new error classification called “critical”. If an Electronic Navigation Chart (ENC) is validated and returns a “critical” error it must be fixed prior to release to the public as it has been established by the International Hydrographic Organizations that ENCs having “critical” errors may not work properly within a navigation system.

MCD requires an ENC validation package that will allow for telework capabilities and the ability to transition the remainder of their cartographic workforce to ENC production. SevenC’s software is the only known software compatible with Citrix that will allow more than 10 users at a time. S-58 has introduced a new classification that will enable MCD to catch “critical” errors that if un-caught may cause the data to load improperly in shipboard navigation systems. MCD requires quarterly S-58 updates.

Any rejection of ENCs results in inefficiencies, confusion and possible missing critical errors. MCD ENCs are accepted for distribution by the International Center for ENCs in the United Kingdom. This organization uses SevenCs to validate and run other quality assurance on MCD ENCs. Without the ability to replicate any errors that this organization finds, MCD would not be able to correct their charts properly when they are rejected for distribution.

The software that SevenCs produces meets MCDs requirements by having the ability to utilize concurrent license structure – thus allowing MCD to reduce its license foot print. SevenCs has developed this software and does not have resellers. This software and license is proprietary and no other company has the source code to provide this product, licenses, or maintenance services. Special Notice This is the only notice to be posted.

This special notice is not a request for competitive offers and no solicitation package is available. However, firms that believe they can provide the needed software licenses may submit substantiating documentation in writing within the open period of this notice. Responses can be sent via e-mail to shelley.neubert@noaa.gov. Documentation will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis.

A determination by the Government not to conduct a competitive procurement, based upon response to this notice, is solely within the discretion of the Government. Oral communications are not acceptable in response to this notice. If no documentation is received, award will be made directly to Boeing Digital Services, Inc. DOC, Eastern Region Acquisition Division requires that all contractors doing business with this office be registered with the System for Award Management (SAM).
